Divorce

Divorce is defined as the dissolution of marriage before the death of either spouse. This definition can also be applied to seperations and annulments, however differences exist between the three classifications of marital dissolution.

Child custody, alimony, and the division of assets are just some of the issues which can be presented during divorce proceedings. The court looks for evidence of infidelity, amoral behavior, physical and mental abuse as well as other factors to determine which party is awarded custody, compensation, and assets after the divorce. Earnings potential, prenuptial agreements, and previous financial commitments are some of the less arbitrary factors involved with divorce proceedings.

Depending on if the seperation of the two parties was amicable and how much "red tape" must be sorted, a divorce can be quick and painless or a grueling, arduous process. A divorce is the legal dissolution of marriage by a court of law. Mediation between both parties can help to ease the cancelling of the marriage contract and in reaching amicable settlements in order to proceed with the divorce. Divorce mediation has become a popular method for easing the process of divorce and avoiding expensive, prolonged litigation between the divorcing spouses.
